In January 2026, a rumor spread online that Erika Kirk, widow of conservative commentator Charlie Kirk and CEO of Turning Point USA, lost her children in a custody battle with her late husband's parents.

However, there was no evidence supporting this allegation, which spread widely following a comment from U.S. Rep. Anna Paulina Luna, R-Fla., who later said she misspoke. A search for relevant court records and news articles returned no results.
Given that court records can be sealed due to safety and privacy concerns, however, we have not rated this claim. Kirk has two children with her late husband.
Luna did not mean Kirk 'lost her kids'
In an October 2025 appearance on the PBD Podcast, hosted by conservative media personality Patrick Bet-David, Luna said Kirk "lost her husband, she lost her kids" (at 1:42:25).
X user @DiligentDenizen posted the clip on Jan. 8, asking Luna what she meant when she said Kirk lost her kids (archived).
Luna responded in an X post that she "meant to say the kids lost their dad."
"PBD podcast is not edited so it was not changed or taken out," she added.

But I do think that when the information isn't put out there directly, that's when you have a lot of these, "Well, you know, could Erika have been involved in any of that?" And that's what I'm saying — like, I don't think that she at all had any connection to that. When I see that, it's like, you're already victimizing the victim, if that makes sense. Because at the end of the day, she did lose her husband, she lost her kids. Like, I was just with her at the White House, and she's, you know — that's anyone — if that happened to your wife, my husband — like, it's devastating.
No evidence of custody battle
Searches for custody battles in locations tied to Kirk found no results. For example, Kirk's family reportedly resided in Scottsdale, Arizona, for many years. A family court case search for "Kirk, Erika" in Maricopa County, where Scottsdale is located, returned no results.
It was unclear whether Kirk moved out of Scottsdale or has been living somewhere else following her husband's death; a real estate website reported that the family listed their home for sale in 2024. As of this writing, Kirk was employed at Turning Point USA, whose business
A search for any court cases related to "Erika Kirk" in Indianapolis returned only traffic infractions. It was not possible to search family court records for Kirk's name in New York, as the system
Finally, a Google search for "Erika Kirk custody battle" returned no relevant results. If Kirk was engaged in a public custody battle with her late husband's parents, it would have likely made news.
